Terms and conditions of sale

PLEASE READ THE GENERAL TERMS AND CONDITIONS OF SALE APPLICABLE TO ALL ORDERS PLACED OU OUR WEBSITE.
 
Article 1: Scope
   The general terms and conditions of sale apply exclusively to the present and future commercial relations between the seller Betjeman and Barton, 22 rue Malesherbes 75008 Paris, France (“us”) and the buyer (“you”).
We reserve the right to modify these general terms and conditions of sale at any time, provided that these modifications are posted on our site.
 
Article 2 : Order
   We undertake to accept your order in accordance with these general terms and conditions of sale.
When ordering, we will inform you of the availability of the products you wish to purchase.However if, in spite of our vigilance, it turns out that the products are temporarily unavailable (out of stock, new products into stocks, etc...) after your order has been placed, we will notify you by e-mail and invite you to cancel or modify your order. If it turns out that the products are definitively unavailable ( sold out, etc...) after ordering, we will automatically cancel your order and notify you by e-mail before proceeding with the reimbursement of any sums paid for that part of the order relating to the unavailable products.
In confirming your order, you accept the entirety of these general terms and conditions of sale made available to you on the site and you agree that you have full knowledge of them, thereby waiving any conflicting terms and in particular your own terms and conditions of purchase, the act of purchase by the buyer entailing acceptance of these general terms and conditions of sale. This confirmation, as well as all data recorded by us, shall be the proof of our transactions.
 
Article 3 : Prices
   The prices quoted in Euro are inclusive of tax at the current French tax rates, exclusive of transport charges. We reserve the right to revise our prices at any time. We undertake to apply the prices in force as quoted at the time when you placed your order.
For orders outside the European Union, prices are zero rated for VAT when entering your delivery address in the appropriate form. Customs duties may be added to the transport charges. Under no circumstances, will we be obliged to assume additional costs relating to delivery of the order ( other than transport charges) to those described and invoiced at the time when you placed the order on our site.
 
Article 4 : Payment
   The amount is immediately payable on the date when your order is placed. Only payment by credit cards is accepted. Cards issued by banks domiciled outside France must obligatorily be international credit cards. The secured online payment by credit card is completely safe: it uses SSL (Secure Socket Layer) protocol. The information transmitted is encrypted by a software and cannot be read during transmission via the network.
We opted for the Elysnet online payment by Crédit Commercial de France, 103, avenue des Champs Elysées – 75008 Paris ( France). Your order will only be handled once your payment has been received and confirmation of receipt has been notified to our services by CCF.
 
Article 5 : Delivery
   Except as otherwise stated, delivery will be made to the address specified in your order.Risk will pass to you from the date when the ordered products leave our premises.The delivery dates are indicative only except if, in particular instances, we have undertaken to comply with a specific delivery date. Please read the additional information relating to delivery.
 
Article 6 : Return and reimbursement
   We guarantee the quality and good condition of all the items we send. We will not be liable for damage due to transport or delivery. We do not refund goods.
In accordance with French legislation, you shall have a period of seven (7) days from receipt of goods in which to retur any items which are not to your satisfaction.You have the right to request either reimbursement of the cost of the goods initially purchased or the replacement of the goods.
 
Article 7 : Retention of title
   The delivered goods will remain our property until complete fulfilment of your obligations towards us and in particular until payment in full of the price together with any interest thereon. This retention of title does not prevent the transfer of risk to the buyer as from the date when the ordered products leave our premises in accordance with the provisions of clause 5.
 
Article 8 : Guarantee in respect of hidden defects and liability
   In the event that the delivered products reveal hidden defects, we may, at our choice, rectify this defect or replace the defective product with another one. If we do not wish to rectify the defect nor replace the defective product, or if we are unable to do so, or cannot do so within any specified time period owing to factors beyond our control or volition, you may, at your option, return this product against repayment of the sale price and return costs or ask us to reduce the price.
The products we offer are in conformity with current French legislation.
We undertake to use all care in accordance with the standards of our profession in providing the service we offer to customers. Nevertheless, we shall not be liable for any breach of our contractual obligations resulting from a fortuitous event or in case of force majeure, including without limitation any catastrophe, strike, fire, flood, failure or breakdown of equipment, means of transport, communication or resulting from your conduct.
Moreover, we will not be liable for any delay due to products being out of stock or for any error in presentation of the products on our site, photographs, texts and illustrations of these products not being of a contractual nature.
 
Article 9 : Data protection and privacy
   We undertake to protect your personal data. By accepting these general terms and conditions of sale you acknowledge that you are aware of our confidentiality undertaking and you agree that we may collect and use these data.
 
Article 10 : Applicable law and jurisdiction
   These general terms and conditions of sale are governed by French law and the Vienna Convention on contracts for the international sale of goods, excluding the United Nations right of sale. Any dispute relating to the commercial relations between ourselves are subject to the exclusive jurisdiction of the French courts.
