Please read the General Terms and Conditions of Sale applicable to all orders placed via our website.
Article 1: Scope
The general terms and conditions of sale apply exclusively to the current and future trade relations between Betjeman and Barton, 23 bd Malesherbes 75008 Paris, France (hereinafter referred to as "we" or "us") and the author of the order (hereinafter referred to as "you").
We may modify these general terms and conditions of sale at any time subject to the publication of said modifications on our website.
Article 2: Order
We hereby undertake to accept your order under the terms of these general terms and conditions of sale.
Upon order placement, we shall inform you of the availability of the products that you wish to purchase. Nonetheless, should the products appear temporarily unavailable (out of stock, republication, etc.) after order placement and despite our best efforts, we shall inform you thereof by email and ask you to either cancel or modify your order. If the products appear permanently unavailable (end of stock, etc.) after order placement, we shall automatically cancel your order and inform you thereof by email before refunding you any sums that have been paid in relation to the missing products.
By confirming your order, you accept all of these general terms and conditions of sale as displayed on the website, acknowledge having perfect knowledge hereof and therefore waive the right to invoke any contradicting document, and notably your own terms and conditions of purchase, as the act of purchase entails your strict acceptance hereof. This confirmation and all of the data recorded shall constitute proof of our transactions.
Article 3: Prices
The prices indicated in Euros are considered to include all taxes according to the rates in effect in accordance with French tax laws, exclusive of shipping costs. We hereby reserve the right to modify our prices at any time. We undertake to apply the tariffs in effect and stipulated at the time of order placement.
For orders originating from outside of the European Union, the prices shall be amended with the VAT amount after entering your delivery address in the relevant form. Any custom's charges may be added to the total shipping costs. In no event shall we be required to assume any additional costs related to the delivery of the order with the exception of the shipping costs described and invoiced on finalising the order on our website.
Article 4: Payment
The price is immediately payable at the order date. Cards issued by banks residing outside of France must be international bank cards. Online payment by bank card is secure and uses the SSL (Secure Socket Layer) protocol. The information transmitted is software-encrypted and cannot be read when sent over the network.
We have selected the Sogecommerce online payment solution by Société Générale. Your order can only be processed after your payment has been accepted and after said acceptance is transmitted to our services by the CCF.
It is also possible to pay by cheque, bankwire transfer or by credit card with Paypal.
Article 5: Delivery
Unless stated otherwise, deliveries are made to the address provided during order placement. The risks shall be transferred to you from the date at which the products ordered leave our premises. The delivery deadlines are provided as a guide only unless we exceptionally undertake to honour a precise delivery date. Please read the additional information regarding deliveries here.
Article 6: Returns and refunds
We hereby guarantee the quality and good condition of all items shipped by us. We shall not be held liable for any damage suffered by the order during shipment or delivery.
We do not accept product returns without specific prior approval.
However, pursuant to Articles L.221-18 et seq. of the French Consumer Code, you are entitled to return any item not to your liking and request an exchange or a refund free of charge within a period of fourteen (14) working days from receiving your order.
In all cases, the return shipping costs remain at your expense.
Article 7: Retention of title
The goods delivered shall remain our property until a time at which all of your obligations towards us have been fulfilled, and notably until the full payment of the price, where necessary with added interest. This retention of title shall not hinder the transfer of risks, for which you shall be responsible from the date at which the products ordered leave our premises, in accordance with the provisions of Article 5 herein.
Article 8: Warranty against latent defects and liability
In the event that the products delivered by us have a latent defect, we may choose to rectify this defect or replace the defective product with another. In the event that we neither wish to rectify this defect or replace the defective product, or if we are unable to do this, or unable to do this within the allotted period of time due to elements that are out of our control, you may choose to return the product to us for a refund of the price and return shipping costs or request a reduction of the sale price.
The products proposed comply with the French legislation in effect.
We undertake to make every effort considered to be usual in the profession to carry out the service offered to the customer. Nonetheless, we may not be held liable in the event of non-compliance with our contractually-binding obligations resulting from an Act of God such as, however not limited to, natural disasters, strikes, fires, floods, a failure or breakdown affecting equipment, transportation means or communication means, or any event resulting from your actions.
Moreover, we may not be held liable in the event of a delay caused by a stock shortage or in the event of an error concerning the presentation of the products on our website, it being stipulated that the photographs, texts and illustrations representing our products are not contractually-binding.
Article 9: Protection of personal data
We hereby undertake to protect your personal data. By accepting these general terms and conditions of sale, you acknowledge having read our non-disclosure agreement and agree to the collection and use of this data.
Article 10: Applicable law and competent court
These general terms and conditions of sale are subject to French law and to the Vienna Convention on contracts for the international sale of goods, excluding the right of sale of the United Nations. All litigations regarding the trade relations existing between you and us are submitted before the exclusive jurisdiction of French courts.
